Terms and Conditions of Providing Services by Electronic Means

I. General Provisions

Implementing the provisions of art. 8 sec. 1 of the Act of 18 July, 2002 on Providing Services by Electronic Means (Journal of Laws of 2017, item 1219), Act of 16 July, 2004 – The Telecommunications Law (Journal of Laws from 2014, item 243, as amended) Strato Minis Studio sp z o. o. with its registered office in Wrocław, hereinafter referred to as the “Service Provider”, hereby introduces these terms and conditions, hereinafter referred to as the “Terms and Conditions”, specifying, in particular, the types and scope of services provided by electronic means, the terms of providing these services, including technical requirements and prohibitions of unlawful content delivery, privacy policy, terms of concluding and terminating contracts for providing services by electronic means and conditions for sending commercial information.
These Terms and Conditions define the types and scope of services provided by Strato Minis Studio sp. z o.o. by electronic means via the website available at https://stratominis.com/, the terms of concluding and terminating contracts, the procedure for complaint proceedings and the rules and technical conditions for providing services by electronic means.
The owner of the Website and the entity providing services via the Website is Strato Minis Studio sp. z o.o. with its registered office in Opole, postal code 45-401, ul. Chełmska 7/10, KRS 0000647764, NIP (Tax Identification Number) 7543132212, the share capital of PLN 5000.00.
Each Service Recipient is obliged to read the content and comply with the provisions of these Terms and Conditions from the moment of taking any steps to use the services provided via the Website or otherwise seeking to use the website https://stratominis.com/. The consent to comply with these Terms and Conditions when starting the service available at https://stratominis.com/ is tantamount to full acceptance of the terms of the Terms and Conditions without the need to draw up a separate contract.
Each Website User has the opportunity to access these Terms and Conditions at any time via the website https://stratominis.com/shipping-and-privacy-policies/ being part of the Website.

II. Definitions

Stratominis.com or Service Provider – this is understood as Strato Minis Studio sp. z o.o. with its registered office in Opole, postal code 45-401, ul. Chełmska 7/10, KRS 0000647764, NIP 7543132212, the share capital of PLN 5000.00, providing Services in accordance with the Terms and Conditions.
Service Recipient or User – an entity using the services of the Service Provider who is a party to the contract for providing services being a natural person, legal entity or organizational unit without legal personality, which undertakes to comply with these Terms and Conditions. The Service Recipient is also an entity that will order the provision of specific services by electronic means on the terms set out below.
Website – a website located at the following address: https://stratominis.com/, through which Strato Minis Studio sp. z o.o. provides services by electronic means.
Services – it means services provided by the Service Provider as part of the Website.
Providing services by electronic means – providing services by Strato Minis Studio sp. z o.o, which comprises transmitting and collecting data by means of teleinformation systems, at the individual request of a service recipient, without the parties being simultaneously present, while the data are transmitted through public networks within the meaning of the Act of July 21, 2000 – The Telecommunications Law.
Teleinformation system – a set of co-operating information devices and software ensuring processing and saving, and also transmitting and collecting of data within telecommunications networks by means of a terminal appropriate for the kind of the given network within the meaning of the Act of 21.07.2000. – The Telecommunications law.
Electronic communication means – technical measures, including teleinformation equipment and software tools co-operating with it, enabling individual distant communication by using data transmission between teleinformation systems, in particular electronic mail.
Commercial information – means any information used for the direct or indirect promotion of services or reputation of Strato Minis Studio sp. z o.o., available on the Service Provider’s Website. Commercial information available on the Website is an invitation to enter into a contract and does not constitute an offer within the meaning of art. 66 and subsequent of the Act of April 23, 1964 – Civil Code.

III. Type and Scope of Provided Services

Strato Minis Studio sp. z o.o. provides the following services via the Website:It provides the Service Recipient with commercial information on the products presented by the Service Provider on the Website at https://stratominis.com/ and provides the ability to search, view, order and purchase products,
1. it informs about the conditions necessary to conclude a contract for providing services selected by the Service Recipient and the requirements for using the services,
2. it informs about current promotions regarding services provided by Stratominis.com,
3. it allows to create and manage a personal Service Recipient account on Stratominis.com.
The Service Provider may also provide services based on separate contract, the subject of which is providing services by electronic means.

IV. Condidions for Providind Services by Electronic Means and Special Threats Related to Using the Website

By using the Website’s services, the User is obliged to comply with and fulfill the following technical requirements:
a) having internet connection,
b) having access to a web browser enabling the display of documents on the website on the computer monitor (recommended Mozilla Firefox minimum version 24.0, Opera version 10, Google Chrome version 28.0 or higher or MS Internet Explorer version 8.0 or higher), which ensures support for cookies and Javascript. It is permissible to use other versions of web browsers, if they ensure full compatibility with the versions mentioned above.
The use of services provided by electronic means involves the risk of infecting the IT system with undesirable software, including the one whose only purpose is to cause damage. For the sake of security of using the Website, it is recommended that the device used by the Service Recipient have in particular:
1. antivirus system with the latest version of virus definitions and updates. It is recommended that the antivirus program be constantly updated as soon as the updates are possible to install.
2. effective firewall,
3. installed all available operating system and web browser updates regarding security,
4. activated acceptance function of cookies and Java Script in a web browser,
5. software for reading files in PDF format.
Apart from the threats resulting from infecting the IT system, there are also hacker attacks among possible threats. The Service Provider declares that security measures to prevent or significantly impede the hacking of the Service Provider’s system are applied.
The Service Provider is not responsible for technical problems related to the malfunctioning of the electronic equipment owned by the Service Recipient and for the lack of parameters enabling the Service Recipient to collect data.
The Service Provider shall not be liable for the risks related to the use by the Service Recipient of services provided by electronic means. In particular, the Service Provider shall not be liable for damage not resulting from his fault or negligence, as well as for the one whose sole cause is the operation of the Service Recipient or third parties for which the Service Provider is not responsible.

V. Protection of Personal Data and Privacy Policy

The Service User may browse the Website anonymously. However, in the case of registration of participation in the service or if a contract between the Service Provider and the Service Recipient is concluded via the Website, the Service Recipient is obliged to provide the Service Provider with his personal data necessary to provide the service.
Personal data provided by the User will be processed by Strato Minis Studio sp. z o.o. in accordance with the General Data Protection Regulation (Official Journal of the European Union L. of 2016, No. 119, page 1), the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1182) and the provisions of these Terms and Conditions.
The data controller is Strato Minis Studio sp. z o.o. with its registered office in Opole, postal code 45-401, ul. Chełmska 7/10. The Data Protection Officer is Rafał Zerych, who can be contacted on +48 604184118 or at the email address rafal.zerych@stratominis.com. The Data Protection Officer shall respond to Users’ messages within a maximum of 7 days.
Strato Minis Studio sp. z o.o. processes Users’ personal data necessary to create, change or terminate the legal relation (providing services by Strato Minis Studio sp. z o. o.) provided by the User in the order form, based on Article. 6 par. 1 lit. b of the General Data Protection Regulation (GDPR), as well as for the promotional and commercial activities of the Service Provider, if the Service Recipient expressed consent for such activities.
The provision of personal data by the User is voluntary, however, it is necessary for the proper performance of services provided through the Website by Strato Minis Studio sp. z o.o.
Possible recipients of personal data of Users of Stratominis.com online shop:
1. in order to make the payment for the product ordered in the online shop available on the Website by the User registered on the Website, his personal data required to make the payment are made available to PayPal (Europe) S.à.r.l. & Cie, S.C.A with its registered office at address L-1150 in Luxembourg;
2. for the proper functioning of the Website we cooperate with entities that are a third party. These entities are the recipients of the following personal data of Website Users:
  - Woocommerce – mailing and contact data,
    Woo Custom Emails Per Product – contact data for sending emails containing site’s terms and conditions,
  - Woo Additional Terms – for the purpose of obtaining the required consent related to the return conditions,
  - Woo Send Email – contact data for the purpose of sending additional e-mails related to the order,
  - Google – contact data and correspondence,
  - Google Analytics – Service Recipient traffic on the website analysis,
  - WordPress – User’s contact data, product ratings along with Service Recipient IDs provided by Service Recipients,
  - iThemes Security – IP data for the purpose of protection of the website.
3. in the case of a User who at the online shop available on the Website chooses method of delivery by post, the Data Controller makes the collected personal data of the User available to the selected carrier or intermediary performing the shipment at the request of the Data Controller;
4. in the case of a User who at the online shop available on the Website chooses method of delivery by pallet or courier, the Data Controller collected personal data of the User available to selected carrier or intermediary performing the shipment at the request of the Data Controller.
Users ‘data shall not be disclosed to any other entities, unless it is required by applicable law or unless a contract that guarantees the protection of Users’ rights is concluded.
The User has the right to access to and rectification or erasure of personal data or restriction concerning the data subject or to object to processing, as well as the right to data portability, at any time. For this purpose, the User should submit a relevant request via e-mail sent to Stratominis.com to the address studio@stratominis.com.
Upon Service Recipient’s termination of the use of services provided by Service Provider, as a result of termination, refusal to accept amendments to the Terms and Conditions, personal data of the Service Recipient may be processed to the extent necessary to achieve the following purposes:
a) establishing responsibility for User’s violation of law and Terms and Conditions,
b) determining whether the user’s use of the services was in accordance with the Terms and Conditions and the law.
The User has the right to lodge a complaint with the President of the Office for Personal Data Protection if he believes that his personal data is processed contrary to the the General Regulation on the Protection of Personal Data and the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
If the Service Recipient uses the Website in violation of the law, in a manner inconsistent with the Terms and Conditions or to the detriment of Stratominis.com, the Service Provider reserves the right to process the Service Recipient’s personal data to the extent necessary to determine accountability and hold the User accountable. In this case, Stratominis.com reserves the right to prevent the Service Recipient from accessing the Website.

VI. Conclusions and Termination of the Contract for Providing Services by Electronic Means

These Terms and Conditions are made available for viewing, downloading, saving and printing free of charge to every User browsing the content posted on the Website.
Each Service Recipient is required to read the content of these Terms and Conditions. These Terms and Conditions form an integral part of the contract for the providing services by electronic means concluded via the www.stratominis.com Website. The Service Provider shall not be liable for damage caused to the Service Recipient as a result of failure to become aware with the content of the Terms and Conditions.
By using the services provided by Stratominis.com via the Website www.stratominis.com, the User confirms that he has read the Terms and Conditions before starting to use services and that the terms of providing services by electronic means by Stratominis.com via the Website specified in these Terms and Conditions are understandable to him and he accepts them.
Detailed rules for the conclusion and termination of the sales contract through Stratominis.com are regulated in the Terms and Conditions of the online shop available at: https://stratominis.com/terms-and-conditions.

VII. Rights and Obligations of the Service Provider

The Service Provider undertakes to provide uninterrupted and stable services by electronic means in accordance with the commercial information provided. The Service Provider is not responsible for technical problems that prevent it from providing services due to force majeure, events for which the Service Provider is not liable, such as as a result of actions of third parties or the Service Recipient.
The Service Provider has the right to temporarily cease providing services due to renovation, maintenance, troubleshooting, incorrect or outdated information, updating and changing the Website’s graphic layout.
The Service Provider reserves the right to conduct maintenance works of the ICT system that may cause difficulties or prevent the Service Recipients from using the services.
In special cases affecting the security or stability of the ICT system, the Service Provider has the right to temporarily cease or reduce providing of services without prior notice and to perform maintenance work aimed at restoring the security and stability of the ICT system.

VIII. Rights and Obligations of the Service Recipient

Before using the services provided by the Service Provider via the Website the Service Recipient is obliged to read the content and comply with the terms of these Terms and Conditions and, when concluding and implementing the contract of sale, the Service Recipient is obliged to proceed in accordance with the Stratominis.com Online Shop Terms and Conditions.
It is unacceptable to place unlawful content on the Website.
The Service Recipient is obliged to use the Website of the Service Provider in a manner consistent with the law, respecting personal rights as well as copyrights and intellectual property of the Service Provider and third parties.
The Service Recipient is obliged to comply with the prohibition of abuse of electronic communication means and to not provide via or to the Service Provider’s IT systems the following content:
1. causing a disturbance of work or overloading of the ICT systems of the Service Provider or other entities that participate directly or indirectly in the providing services via electronic means,
2. infringing the rights of third parties or legitimate interests of the Service Provider, violating generally accepted social norms or good manners,
3. inconsistent with generally applicable laws.

IX. Complaint Procedure

The Service Recipient has the right to file complaints regarding the services provided by the Service Provider via the Website. Complaints may not concern in particular: irregularities in the functioning of the referenced web browser, interruptions in Internet access, the Service Provider’s equipment or Internet connections, circumstances for which the Service Provider is not solely responsible, and other circumstances related to the operation of entities for whose activities the Service Provider is not responsible.
The complaint may be submitted by the Service Recipient via e-mail to the following address: studio@stratominis.com.
The complaint should include the data of the Recipient submitting a complaint in a way that allows his identification, in particular the name, surname, address for delivery, e-mail address. In addition, it is necessary to indicate the subject and scope of the complaint and its brief justification.
Stratominis.com will make every effort to resolve the complaint within 30 days from the date of receipt of the complaint to the Service Provider. The Service Recipient shall be informed about the method of handling the complaint in the manner in which the complaint was made or by post sent to the address provided in the complaint.

X. Final Provisions

These Terms and Conditions shall enter into force on the day of its announcement. The announcement is made by placing these Terms and Conditions on the Website.
For matters not covered by these Terms and Conditions, the provisions of generally applicable law shall apply.
The Service Provider reserves the right to change the provisions of the Terms and Conditions at any time without giving a reason. Amendments to the Terms and Conditions come into force on the day they are announced on the Website, and any previous provisions in the scope of made amendments shall cease to apply subject to point 4 and point 5 below.
In the case of conclusion of continuous contracts under these Terms and Conditions (e.g. provision of electronic Service – “Client Account”), the amended Terms and Conditions are binding for the Service Recipient if the requirements specified in art. 384 and 384 (1) of the Civil Code were satisfied, i.e. the Service Recipient was correctly informed about the changes and did not terminate the contract in writing or by e-mail to the following address: studio@stratominis.com within 14 days of notifying the Service Provider of any changes to the Terms and Conditions. If the Service Provider does not submit a refusal within the prescribed time and form, it is assumed that the Service Recipient has read the content of the changes, these changes are understandable to him and he accepted them. When the change in the Terms and Conditions results in the introduction of any new fees or the increase of existing fees, the Service Recipient who is a consumer has the right to withdraw from the contract.
In the case of concluding agreements of a nature different from continuous contracts under these Terms and Conditions, amendments to the Terms and Conditions shall not in any way infringe the rights of the acquired Service Recipients who are consumers before the amendments come into force, in particular amendments to the Terms and Conditions shall not affect already being placed or placed orders and concluded, implemented or executed sales contracts at the online shop.
All information, data and materials available on the website (including, among others, names, logos and price lists) and all other intellectual property rights related to the content of the website belong to Stratominis.com and are protected by copyright, trademark rights, database rights or other intellectual property rights.

Regulamin świadczenia usług drogą elektroniczną

przez Strato Minis Studio sp. z o.o.

I. Postanowienia ogólne

Realizując postanowienia art. 8 ust. 1 ustawy z dnia 18.07.2002 r. o świadczeniu usług drogą elektroniczną (t.j. Dz. U. z 2017 r. poz. 1219), ustawy z dnia 16 lipca 2004 roku prawo telekomunikacyjne (Dz.U. z 2014 r. poz. 243 z późn. zm) Strato Minis Studio sp. z o.o. z siedzibą we Wrocławiu, zwana w dalszej części Regulaminu „Usługodawcą”, wprowadza niniejszy regulamin, zwany dalej „Regulaminem”, określający w szczególności rodzaje i zakres świadczonych usług droga elektroniczną, warunki świadczenia tych usług, w tym wymagania techniczne oraz zakazy dostarczania treści bezprawnych, politykę prywatności, warunki zawierania i rozwiązywania umów o świadczenie usług droga elektroniczną oraz warunki przesyłania informacji handlowej.
Niniejszy Regulamin określa rodzaje i zakres usług świadczonych przez Strato Minis Studio sp. z o.o. drogą elektroniczną za pośrednictwem strony internetowej dostępnej pod adresem https://stratominis.com/, warunki zawierania i rozwiązywania umów, tryb postępowania reklamacyjnego oraz zasady i warunki techniczne świadczenia usług drogą elektroniczną.
Właścicielem Serwisu i podmiotem świadczącym usługi w ramach Serwisu jest Strato Minis Studio sp. z o.o. z siedzibą w Opolu, kod pocztowy 45-401, ul. Chełmska 7/10, KRS 0000647764, NIP 7543132212, wysokość kapitału zakładowego 5000,00 zł.
Każdy Usługobiorca zobowiązany jest do zapoznania się z treścią i stosowania się do postanowień niniejszego Regulaminu od momentu podjęcia jakichkolwiek czynności zmierzających do skorzystania z usług świadczonych za pośrednictwem Serwisu lub zmierzających w jakikolwiek inny sposób do korzystania ze strony internetowej https://stratominis.com/. Wyrażenie zgody na przestrzeganie niniejszego Regulaminu przy uruchamianiu usługi dostępnej na stronie https://stratominis.com/ jest równoznaczne z pełną akceptacją warunków Regulaminu bez konieczności sporządzenia odrębnej umowy.
Każdy Użytkownik Serwisu ma możliwość uzyskania dostępu do niniejszego Regulaminu w każdym czasie za pośrednictwem strony internetowej https://stratominis.com/shipping-and-privacy-policies/ będącej częścią Serwisu.

II. Definicje

Stratominis.com lub Usługodawca – rozumie się przez to Strato Minis Studio sp. z o.o. z siedzibą w Opolu, kod pocztowy 45-401, ul. Chełmska 7/10, KRS 0000647764, NIP 7543132212, wysokość kapitału zakładowego 5000,00 zł, świadczącą Usługi zgodnie z treścią Regulaminu.
Usługobiorca lub Użytkownik – podmiot korzystający z usług Usługodawcy, który jest stroną umowy o świadczeniu usług będący osobą fizyczną, osobą prawną albo jednostką organizacyjną nie posiadającą osobowości prawnej, który zobowiąże się do przestrzegania niniejszego Regulaminu. Usługobiorcą jest również podmiot, który zamówi świadczenie określonych usług drogą elektroniczną na zasadach poniżej określonych.
Serwis – serwis internetowy znajdujący się pod adresem strony internetowej: https://stratominis.com/, za pośrednictwem którego spółka Strato Minis Studio sp. z o.o. świadczy usługi drogą elektroniczną.
Usługi – rozumie się przez to usługi świadczone przez Usługodawcę w ramach Serwisu.
Świadczenie usług droga elektroniczną – oznacza wykonywanie usługi przez Strato Minis Studio sp. z o.o., które następuje przez wysyłanie i odbieranie danych za pomocą systemów teleinformatycznych, na indywidualne żądanie odbiorcy, bez jednoczesnej obecności stron (na odległość), przy czym dane te są transmitowane za pomocą sieci publicznych w rozumieniu ustawy z dnia 21.07.2000 r. Prawo telekomunikacyjne.
System teleinformatyczny – zespół współpracujących ze sobą urządzeń informatycznych i oprogramowania, zapewniający przetwarzanie i przechowywanie, wysyłanie i odbieranie danych poprzez sieci telekomunikacyjne za pomocą właściwego dla danego rodzaju sieci urządzenia końcowego w rozumieniu ustawy z dnia 21.07.2000r. Prawo telekomunikacyjne.
Środki komunikacji elektronicznej – rozwiązania techniczne, w tym urządzenia teleinformatyczne i współpracujące z nimi narzędzia programowe, umożliwiające indywidualne porozumiewanie się na odległość przy wykorzystaniu transmisji danych między systemami teleinformatycznymi, a w szczególności pocztę elektroniczną.
Informacja handlowa – oznacza każdą informację przeznaczoną bezpośrednio lub pośrednio do promowania usług i wizerunku Strato Minis Studio sp. z o.o., dostępną w Serwisie Usługodawcy. Informacje handlowe dostępne w Serwisie są zaproszeniem do zawarcia umowy i nie stanowią oferty w rozumieniu art. 66 i następnych ustawy z dnia 23.04.1964 r. Kodeks cywilny.

III. Rodzaj i zakres świadczonych usług

Strato Minis Studio sp. z o.o. za pomocą Serwisu świadczy następujące usługi:
1. udostępnia Usługobiorcy informacje handlowe dotyczące prezentowanych przez Usługodawcę towarów na stronie Serwisu pod adresem https://stratominis.com/ oraz zapewnia możliwości wyszukiwania, przeglądania oraz dokonywania zamówienia i zakupu towarów,
2. informuje o warunkach koniecznych do zawarcia umowy o świadczenie wybranych przez Usługobiorcę usług oraz o wymogach korzystania z usług,
3. informuje o aktualnych promocjach dotyczących usług świadczonych przez Stratominis.com,
4. umożliwia utworzenie osobistego konta klienta na stronie Stratominis.com i zarządzanie nim.
Usługodawca może świadczyć również usługi na podstawie odrębnych umów, których przedmiotem jest świadczenie usług drogą elektroniczną.

IV. Warunki świadczenia usług drogą elektroniczna oraz szczególne zagrożenia związane z korzystaniem z

Użytkownik korzystając z usług Serwisu zobowiązany jest przestrzegać i spełniać następujące wymagania techniczne:
1. posiadać podłączenie do Internetu,
2. posiadać dostęp do przeglądarki internetowej umożliwiającej wyświetlanie na monitorze komputera dokumentów znajdujących się na stronie internetowej (zalecane Mozilla Firefox wersja minimum 24.0, Opera od wersji 10, Google Chrome w wersji 28.0 lub nowszej lub MS Internet Explorer w wersji minimum 8.0 lub nowszej), która zapewnia obsługę plików cookies oraz skryptów Javascript. Dopuszczalne jest stosowanie innych wersji przeglądarek internetowych, jeżeli zapewniają one pełną zgodność z wersjami wymienionymi powyżej.
Korzystanie z usług świadczonych drogą elektroniczną wiąże się z wystąpieniem ryzyka zainfekowania systemu informatycznego przez niepożądane oprogramowanie, także takiego którego jedynym celem jest wyrządzanie szkód. Dla zachowania bezpieczeństwa korzystania z Serwisu, zaleca się, aby urządzenie, z którego korzysta Usługobiorca posiadało w szczególności:
1. system antywirusowy z najnowszą wersją definicji wirusów i uaktualnień. Zaleca się, aby program antywirusowy był stale aktualizowany, niezwłocznie po ukazaniu się aktualizacji możliwych do zainstalowania.
2. skuteczną zaporę bezpieczeństwa (firewall),
3. zainstalowane wszystkie dostępne aktualizacje systemu operacyjnego oraz przeglądarki internetowej, które dotyczą bezpieczeństwa,
4. aktywowaną funkcję akceptacji plików cookies oraz Java Script w przeglądarce internetowej,
5. oprogramowanie umożliwiające odczyt plików w formacie PDF.
Poza zagrożeniami wynikającymi z zainfekowania systemu informatycznego, wśród możliwych zagrożeń znajdują się także ataki hackerów. Usługodawca oświadcza, iż stosuje zabezpieczenia mające na celu uniemożliwienie lub znaczne utrudnienie włamania się do systemu Usługodawcy.
Za problemy techniczne, związane z wadliwym funkcjonowaniem posiadanego przez Usługobiorcę sprzętu elektronicznego oraz za brak parametrów umożliwiających Usługobiorcy odbiór danych Usługodawca nie ponosi odpowiedzialności.
Usługodawca nie ponosi odpowiedzialności za ryzyko wiążące się z korzystaniem przez Usługobiorcę z usług świadczonych drogą elektroniczną. W szczególności Usługodawca nie ponosi odpowiedzialności za szkodę nie będącą następstwem jego winy czy zaniedbania, a także za taką, której wyłączną przyczyną jest działanie Usługobiorcy lub osób trzecich, za które Usługodawca nie ponosi odpowiedzialności.

V. Ochrona danych osobowych i polityka prywatności

Usługobiorca może przeglądać stronę internetową Serwisu anonimowo. Jednak w przypadku dokonania zgłoszenia uczestnictwa w usłudze lub gdy za pośrednictwem Serwisu pomiędzy Usługodawcą a Usługobiorcą zawierana jest umowa, Usługobiorca zobowiązany jest do podania Usługodawcy swoich danych osobowych, niezbędnych do świadczenia usługi.

dochodzenia odpowiedzialności w związku z naruszeniem przez użytkownika przepisów prawa oraz regulaminu,

Usługodawca nie ponosi odpowiedzialności za problemy techniczne uniemożliwiające jej świadczenia usług zaistniałe z powodu siły wyższej, zdarzeń, za które odpowiedzialności Usługodawca nie ponosi, jak np. w wyniku działania osób trzecich lub Usługobiorcy.
Usługodawca ma prawo do czasowego zaprzestania świadczenia usług z powodu czynności renowacyjnych, konserwacyjnych, usuwania usterek, błędnych lub nieaktualnych informacji, unowocześniania, jak i zmiany szaty graficznej Serwisu.
1. Usługodawca zastrzega sobie prawo do prowadzenia prac konserwacyjnych systemu teleinformatycznego, mogących powodować utrudnienia lub uniemożliwienie Usługobiorcom korzystania z usług.
2. VIII. Prawa i obowiązki usługobiorcy

Usługobiorca zobowiązany jest do przestrzegania zakazu nadużywania środków komunikacji elektronicznej oraz do niedostarczania przez lub do systemów teleinformatycznych Usługodawcy następujących treści
1. powodujących zachwianie pracy lub przeciążenie systemów teleinformatycznych Usługodawcy lub innych podmiotów biorących bezpośredni lub pośredni udział w świadczeniu usług drogą elektroniczną,
2. naruszających dobra osób trzecich lub uzasadnione interesy Usługodawcy, naruszających ogólnie przyjęte normy społeczne lub dobre obyczaje,
3. niezgodnych z powszechnie obowiązującymi przepisami prawa.

IX. Tryb postępowania reklamacyjnego

Usługobiorca ma prawo składać reklamacje w sprawie świadczonych przez Usługodawcę usług za pośrednictwem Serwisu. Składane reklamacje nie mogą dotyczyć w szczególności: nieprawidłowości w funkcjonowaniu powoływanej przeglądarki internetowej, przerwy w dostępie do Internetu, sprzętu Usługobiorcy lub łączy internetowych, okoliczności, za które Usługodawca nie ponosi wyłączną odpowiedzialność, a także innych okoliczności związanych z działalnością podmiotów, za których działania Usługodawca nie odpowiada.
Reklamacja może być złożona przez Usługobiorcę za pośrednictwem poczty elektronicznej na adres: studio@stratominis.com.
Reklamacja powinna zawierać dane Usługobiorcy wnoszącego reklamację w sposób umożliwiający jego identyfikację, w szczególności imię, nazwisko, adres do doręczeń, adres e-mail. Ponadto, konieczne jest wskazanie przedmiotu i zakresu reklamacji oraz zwięzłe jej uzasadnienie.
Stratominis.com dołoży wszelkich starań, aby reklamacja została rozpatrzona w terminie 30 dni od daty wpływu reklamacji do Usługodawcy. O sposobie rozpatrzenia reklamacji Usługobiorca zostanie poinformowany w sposób w jaki reklamacja została zgłoszona lub listownie na adres podany w reklamacji.

X. Postanowienia końcowe

Niniejszy Regulamin wchodzi w życie z dniem jego ogłoszenia. Ogłoszenie następuje przez umieszczenie niniejszego Regulaminu na stronie internetowej Serwisu.
W sprawach nieuregulowanych w niniejszym Regulaminie stosuje się przepisy powszechnie obowiązującego prawa.
Usługodawca zastrzega sobie prawo do dokonywania zmian postanowień zawartych w Regulaminie w każdym czasie bez podania przyczyny. Jeżeli Usługodawca nie złoży odmowy w wyznaczonym terminie i formie przyjmuje się, że Usługobiorca zapoznał się z treścią zmian, zmiany te są dla niego zrozumiałe i je zaakceptował. Gdy zmiana Regulaminu skutkuje wprowadzeniem jakichkolwiek nowych opłat lub podwyższeniem obecnych Usługobiorca będący konsumentem ma prawo odstąpienia od umowy.
W przypadku zawarcia na podstawie niniejszego Regulaminu umów o innym charakterze niż umowy ciągłe, zmiany Regulaminu nie będą w żaden sposób naruszały praw nabytych Usługobiorców będących konsumentami przed dniem wejścia w życie zmian Regulaminu, w szczególności zmiany Regulaminu nie będą miały wpływu na już składane lub złożone zamówienia oraz zawarte, realizowane lub wykonane umowy sprzedaży w sklepie internetowym.
Wszelkie informacje, dane i materiały udostępniane na stronie internetowej (w tym m.in. nazwy, logotypy oraz cenniki) oraz wszelkie inne prawa własności intelektualnej związane z treścią strony internetowej należą do Stratominis.com i są chronione prawami autorskimi, prawami do znaków towarowych, prawami do baz danych lub innymi prawami własności intelektualnej.
