Terms of License Agreement Between The Strato Minis Studio and the Buyer
The terms herein constitute the frames of the lawful use of Products licensed from Strato Minis Studio. Any use outside of these frames is not allowed.
1. Definitions
1.1. Buyer – a person, who purchases or downloads Content of Strato Minis Studio Site
1.2. Strato Minis Studio – Strato Minis Studio Sp. z o.o. with its registered office in Opole, postal code 45-401, ul. Chełmska 7/10, registered under KRS No.0000647764, having VAT ID No. PL7543132212
1.3. Content – any material published at the Site including but not limited to files, graphics, models presentations, descriptions.
1.4. General Terms – this General Terms and Conditions in its entirety, including all terms and (or) information, accessible via any links, provided in this document.
1.5. Product – any Content, available at Strato Minis Studio Site, offered by the Strato Minis Studio to the potential Buyers for purchase or free download.

2. Rights, obligations, and representations of the Buyer
2.1. The Buyer may not use the Product in a manner that infringes the intellectual property of any other party. Strato Minis Studio is not responsible for any infringements of third parties’ rights resulting from the use of Products by the Buyer.
2.2. The Buyer may not reverse engineer any Product and must abide by the terms of the license granted to the Buyer under this General Terms, as well as any additional Seller terms included with the Product.
2.3. Prior to concluding the contract the Buyer shall give express content of waiving his or her 14-day right of withdrawal regarding Product in a form of digital content.
3. General Terms of Licensing
3.1. Following the payment for Product, the Buyer acquires a license in accordance with the terms and conditions of this section. Any license rights relating to the Product are contingent upon the transfer of money (except for the free Products) from the Buyer to Strato Minis Studio. In the case of free Products, the Buyer acquires the license rights with the moment the Product is downloaded by the Buyer. All license rights terminate immediately and without notice, if a sale is reversed for any reason.
3.2. Buyers are only authorized to use the Product in accordance with the terms and conditions of the license. By means of this license, the Buyer does not acquire any copyrights to the Products.
3.3. The license to use the Product is non-exclusive, non-transferable and is granted only to the original Buyer. Any sublicenses are forbidden unless otherwise agreed with Strato Minis Studio in a written form.
3.4. The license to use Product is revoked at the time Product is returned to Strato Minis Studio or at the time Product should be returned in the light of provisions of applicable law.
3.5. The Product obtained by means of theft or fraudulent activity of any kind is not granted a license.
4. License
4.1. Product may only be used in the frames of private use. Any commercial use of the Product is excluded unless explicitly otherwise provided herein. Product may not be sold or transferred to another person or entity neither in the form, it is downloaded from the Site nor in physical form i.a. printed.
4.2. The Product can be printed, assembled by the Buyer to constitute a model presented on the Site or any other model that may arise from a Product or part of a Product.
4.3. Product may be used as rendered still images or moving images published with the licensee’s identification – Strato Minis Studio.
4.4. Product or graphics of the Product may be published online, posted, promoted, publicly displayed by any means however always with the licensee’s identification – Strato Minis Studio and not for the commercial needs.
4.5. Product may be used as part of a game if the Product is contained inside a proprietary format and displays inside the game during play, but not for users to re-package as goods distributed or sold inside a virtual world. However, this provision does not apply if the game is used for commercial purposes.
4.6. Absent a written grant of rights greater than that contained in section 4 “License”, all other rights or sub-divisions of rights are excluded from this license and remain the property of Strato Minis Studio.
5. License for Products that are offered for free download
The Product that is offered as a free download shall be licensed with one of Creative Commons licenses as chosen by the Seller. Creative Commons licenses and their licensing terms can be found here.
